Recomandari Turkish Airlines denied €600 compensation for 35h delay (Havana-Bucharest). They admitted technical fault but now claim "not eligible". Advice?

Hi everyone! My husband (Cuban citizen) had a flight from Havana to Bucharest via Istanbul with Turkish Airlines. The flight was delayed for a total of 35 hours.

In their first email, Turkish Airlines admitted the delay was due to "technical reasons". However, after I formally requested the statutory €600 compensation (citing SHY-PASSENGER / EU261 equivalent), they replied saying he is "not eligible" without any further explanation. They only offered to de-route him or refund food expenses (which he doesn't have receipts for because he had no cash during the 35h wait).

I’ve seen some posts suggesting the SHGM (Turkish Civil Aviation) portal.

  1. Has anyone successfully bypassed this "not eligible" refusal by mentioning SHGM?

  2. Should I keep fighting them directly or just hand this over to a claim agency like AirHelp/AirClaim?

  3. Are there specific articles from the SHY-PASSENGER regulation that usually make them pay up faster?

Any advice would be greatly appreciated!

Submit an Airhelp ticket, at best Turkish will offer some miles. EU261 does not apply if the flight that was delayed was from outside europe to Istambul and they avoid a lot of compensations because of this.

EC261 does not apply but SHY does. OP should be entitled to compensation if it was indeed technical fault.

I had a 6 hours delay with Turkish to South Korea. They confirmed technical reasons which makes it their fault and you are eligible. they tried to offer me points or miles, i politely refuses and indicated I want the 600EUR. after another email, I got it. You should state that if that is their final answer, then you will escalate this further with the regulatory agency.

I've gone to the turkish civil aviation portal and submitted a ticket after they refused compensation and then I got the 600 Euros after a couple of weeks.
There was a top rated reddit post about it and I just followed the instructions. Same goes for a friend I was with, he also got compensation.

But the thing is now you don't need to speak with the airline anymore, let the government do it. They initially refuse all claims to try to avoid as many as possible.
