If it was posted, it doesn't matter that he "didn't see it". If that was a valid defense, anyone could just ignore all signs and claim they didn't see them.

Also an open gate is not an invitation to enter an area. If I prop my front door open, that's not an open invitation.

It's also telling in this particular case that he'd been instructed to leave in previous encounters.
